Bolsonaro wants Provisional Measure approved before emergency aid law

President Jair Bolsonaro said he will send a provisional measure (MP) to the National Congress and will await its approval before sanctioning the emergency aid of R$ 600 for informal workers. Although Bolsonaro signed the bill approved by Congress yesterday, the measure is not in force because the text has not yet been published in the Federal Office Gazette. Even without publishing the emergency aid law, Bolsonaro said the benefit will begin to be paid next week. The president wants an MP to guarantee him the legality of the extra expense, because in his understanding, Congress must endorse the creation of new expenses, pointing out their source of revenue. Behind this request is his concern about a possible crime of fiscal responsibility.

Despite Bolsonaro’s concern, the Federal Supreme Court (STF) has already ruled on the issue, saying that an MP is not necessary to release the payment of emergency aid. As the state of public calamity is in effect, the additional expenses are authorized and do not violate the Fiscal Responsibility Law (LRF). However, Bolsonaro´s insecurity is a consequence of the clashes between the branches of government that, even with the coronavirus pandemic, continue to boil at a high temperature.
