Breakthrough with judicial reform: parliament approves reboot of the High Council of Justice

We are witnessing a real breakthrough with judicial reform. We wrote previously that on June 29th parliament gave green light for reload of the High Qualification Commission of Justice (HQCJ) with dominating role of international experts in selection of the HQCJ members. The HQCJ is like an HR department of the judicial system responsible for pre-selection of candidates for vacant places of judges. However, it’s the High Council of Justice (HCJ) that says the final word in appointing and dismissing judges. The HCJ also runs disciplinary investigations if some judges are suspected in misconducts. Lawyers used to name the HCJ permissiveness among the key reasons for poor judicial system in Ukraine. Dozens of notorious judges escaped punishment amid loose treatment of their misconducts on the side of the High Council of Justice. Against this backdrop judicial system of Ukraine suffers from poor confidence of society. To make matters worse, many judges used to consider permissiveness of the HCJ as an evidence of impunity. Yesterday, on July 14th, parliament voted in the law which launches reboot of the HCJ under supervision of international experts, the move civil society has been fighting for years. We have many points to criticize president Volodymyr Zelenskiy for but we should acknowledge his historical role in pushing judicial reform. The authorities are trying to deliver as many positive legislative products as they can, hoping that will help with unfreezing the IMF talks.
