OK given to an agreement between Odebretch and the Office of the General Attorney

In what can be interpreted as a victory for the government, yesterday a judge approved the terms of an agreement between Odebretch and the Office of the General Attorney through which the firm accepts to cooperate with the investigation on kickbacks on infrastructure projects and agrees to pay a fine of USD 184 million twice of the amount of the briberies admitted, in exchange for not filing criminal charges against it. Recall that a proposal of a similar kind was rejected by a court weeks ago, forcing the Office of General Attorney to remake it. In our view, cooperation from Odebretch is crucial in order to get down to those who benefited from the bribery scheme. However, since the General Attorney is not truly independent from the Executive, we’re troubled with the possibility that the agreement gives him space to minimize the damage to PLD and the government at the expense of not getting to the bottom of the cases and not finding out the true length of the scheme. We will discuss the issue more extensively in our upcoming report.
